“Rule of Law vs. Rule of Justice: Comparing Anthropologies of Muslim Law.”
This presentation focuses on the challenge of anthropological comparison as it emerges in recent ethnographies of Muslim law. Emphasis on "rule of law" versus "rule of justice" in framing Muslim law represents one arena for comparison that has proved consequential for broader political debates over Muslim law. A critical reading of the literature is combined with examples from Hirsch's longstanding research on Muslim courts in Kenya and her more recent study of Muslim minority communities in Euro-Mediterranean contexts.
