Title: "A New Paradigm for Free Speech on Campus"

Abstract: When it comes to full-throated endorsements of campus free speech, the Chicago Principles (2015) are the only game in town. The dominant critique of these principles is that they permit too much speech, including hate speech. In this presentation, Finkel considers the opposite possibility: That the core problem with the principles is that they fail to foster enough speech. Cultivating a robust public sphere requires protections not only for the person holding the microphone, but also for people who would like to add their voice to the public discourse—but who will opt out if they will be subjected to slurs or personal attacks. Finkel proposes a novel paradigm for campus speech consisting of expansive policies regarding speech substance but restrictive policies regarding speech style.
